1. General provisions
These Terms of Use govern access to and use of the Pulse product website, including the content and functionality available at www.pulsesolutions.io.
The website operator and provider of the Pulse product is RCL Int. d.o.o., Ulica Alme Sodnik 2, 1000 Ljubljana, Slovenia, company registration number 5941113000, VAT number SI 51062186, registered with the District Court in Ljubljana under registration file number 1/28219/00, info@rcl-group.com, +386 1 514 03 50.
In these Terms, RCL Int. d.o.o. is referred to as “RCL”, and any visitor or user of the website is referred to as the “User”. By accessing and using the website, the User acknowledges that they have read and understood these Terms.
2. Purpose of the website
The website is intended to present the Pulse product, its features, possible use cases, benefits, integrations and related services. The information provided is general and for informational purposes only. Unless expressly stated otherwise, website content does not constitute a binding offer, contract, technical specification, warranty or commitment regarding the availability of any particular functionality.
The final scope, functionality, price, implementation method and other conditions applicable to the Pulse product are agreed in a quotation, order, licence agreement, implementation agreement or another written agreement between RCL and the customer.
3. Permitted use
The User may use the website only for lawful purposes and in accordance with its intended purpose and these Terms. In particular, the User must not:
- interfere with the operation or security of the website;
- attempt to gain unauthorised access to the website, servers or information systems;
- introduce or distribute malicious software;
- conduct attacks or activities that may restrict the operation of the website;
- use automated tools to extract content in bulk without RCL’s permission;
- use the website for unlawful, misleading or fraudulent purposes;
- impersonate another person or organisation;
- copy, modify, distribute or commercially exploit content without appropriate permission;
- remove copyright, trademark or other proprietary notices;
- use the website in a manner that may harm RCL, its partners or other users.
Where misuse or a breach is suspected, RCL may restrict or disable access and take other appropriate measures.
4. Contact forms and enquiries
A message submitted through a contact form, email or another communication channel constitutes an enquiry and does not constitute an order or acceptance of an offer. The User is responsible for the accuracy and lawfulness of the information provided. RCL is not required to respond to messages that are manifestly false, abusive or unlawful, unrelated to the website or the Pulse product, or submitted for the purpose of abuse or disruption.
5. Quotations and conclusion of contracts
The presentation of the Pulse product on the website does not constitute a binding offer. A contractual relationship is created only on the basis of a quotation accepted in writing, a signed agreement, a confirmed order, activation of a subscription or another express written agreement. Specific licence, subscription, service or other contractual terms may apply. In the event of a conflict, the specific contractual terms take precedence over these Terms of Use.
6. Product information
RCL aims to provide accurate and up-to-date information about the Pulse product. Images, screenshots, feature descriptions, technical information and use cases may be illustrative and may differ from the actual or current version of the product. RCL may develop, modify or supplement the Pulse product and its functionality.
Information on the website therefore does not guarantee that a particular feature will be included in every version, available in every country or language, compatible with every information technology environment, possible without additional development or deliverable within a particular timeframe or at a particular price.
7. Prices and commercial terms
Any prices, estimates, packages or calculations displayed on the website are for informational purposes only, unless expressly stated otherwise. The final price may depend on the number of users, selected package or licensing model, required functionality, customisations, integrations, data migration, implementation, training, support and maintenance, country of use, local requirements and terms imposed by third-party providers. RCL reserves the right to change published information and prices. Such changes do not affect existing contracts unless otherwise provided in the applicable agreement.
8. Intellectual property rights
Website content, including the Pulse product name and identity, texts, logos, graphics, photographs, videos, illustrations, icons, screenshots, documentation, presentations, software code and the structure and design of the website, may be protected by copyright, trademark or other intellectual property rights. The relevant rights are owned by RCL or by a third party that has authorised RCL to use the content.
The User may use the content for their own non-commercial informational purposes. Without prior written permission, the User may not copy, reproduce, modify, publish, distribute, sell or use the content to develop competing products, create collections or databases, or remove copyright or proprietary notices.
9. Downloadable materials
Documents, brochures, presentations and other downloadable materials are provided for informational purposes. Without permission, the User may not modify, sell, publicly distribute, present as their own, use in a misleading manner or use contrary to the interests of RCL or the relevant rights holder. Materials may relate to a particular product version and may become outdated.
10. External links and third-party services
The website may contain links to websites, platforms or services operated by third parties. RCL does not operate or control third-party websites and is not responsible for their content, accuracy, operation, availability, security measures, privacy policies or terms of use. The User accesses third-party websites at their own risk.
11. Website availability
RCL aims to provide secure and uninterrupted website operation but does not guarantee continuous availability, complete freedom from errors or security risks, compatibility with every device or browser, or freedom from malicious code introduced by a third party despite protective measures. RCL may temporarily restrict or suspend the website due to maintenance, upgrades, security reasons, technical issues, force majeure or other justified reasons.
12. Limitation of liability
To the extent permitted by law, RCL is not liable for decisions made solely on the basis of website information, direct or indirect loss resulting from the use or inability to use the website, loss of data, revenue, profit or business opportunities, temporary unavailability, technical errors, acts of third parties, external website content, incompatibility with the User’s device or software, or damage resulting from cyberattacks or malicious code that RCL could not prevent despite appropriate measures. Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by applicable law.
13. Privacy and cookies
Personal data collected through the website is processed in accordance with the published Privacy Policy. Information regarding cookies and similar technologies is available in the cookie settings or cookie notice.
14. Changes to the website and these Terms
RCL may at any time change or supplement website content, change the presentation of the Pulse product, add or remove website functionality or amend these Terms of Use. The current version will always be available on the website. The date of the latest update is shown at the beginning of this document.
15. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will remain valid and enforceable. The invalid provision will be replaced, to the greatest extent possible, by a valid provision that most closely reflects the original commercial and legal purpose.
16. Governing law and jurisdiction
These Terms and the use of the website are governed by the laws of the Republic of Slovenia. RCL and the User will attempt to resolve any dispute amicably. Where an amicable resolution is not possible, the competent court in Ljubljana, Slovenia, will have jurisdiction, unless mandatory law provides otherwise.
